Terms of Service

These terms are the agreement between you and Viridian Dynamics for your use of www.nova.dating and the Nova apps. Nova Dating is a Viridian Dynamics product. By creating an account you accept these terms.

1. Who can use Nova

  • You must be 18 or over. There are no exceptions, and the service refuses to store an account with a date of birth under 18.
  • You must be legally able to enter into this agreement.
  • You must not have been previously removed from Nova. Bans are enforced against your phone number and survive deleting and recreating an account.
  • You may hold one account. Running several is grounds for removal.
  • You must not be on a sanctions list or required to be registered as a sex offender in any jurisdiction.

2. Your account

You sign in with your phone number. Keep access to that number secure — anyone who can receive your codes can reach your account. Tell us promptly if you think someone else has got in.

You are responsible for what you post and send. Everything on your profile is information you have chosen to make visible to other members.

3. What Nova costs

Nova has a free tier and one paid tier. There is no ladder of four plans, and there is no advertising on either tier.

Free, for everyone

  • Unlimited messaging with every match — no timers, no message caps
  • Up to 25 likes per rolling 24 hours
  • One Hot swipe a week
  • Blocking, reporting and photo verification
  • Filtering by who you want to see, age, distance, and verified-only
  • Overseas mode, and the option to hide people using it
  • Leaving a review, and reading the reviews on a profile
  • Exporting your data, and deleting your account

Nova Premium — $7.50 per month

  • Unlimited likes
  • Seeing everyone who has liked you, rather than only a count
  • Unlimited rewinds
  • The remaining filters: height, home country, eye and hair colour, body type, body art, intentions, family plans, religion, education, lifestyle, star sign, interests and languages
  • Five Hot swipes a week, and priority placement in other members' decks
  • Two profile boosts a week, and a weekly photo performance report

Additional Hot swipes are $1.50 each, are bought individually, and do not expire.

Prices are in Australian dollars and include any applicable tax. We may change them, and we will tell you before a change affects a subscription you already hold.

Cancelling

You can cancel at any time. Cancelling stops the next renewal, and you keep Premium until the period you have already paid for ends. We do not pro-rate refunds for a part-used month, except where the consumer law where you live requires it.

If a payment fails we do not cut you off on the spot — access continues until the paid period genuinely runs out.

What we will not do

  • Charge for safety. Blocking, reporting and verification are free, permanently.
  • Charge for your own data. Export and deletion are free.
  • Sell advertising or your personal information, on either tier.

4. Rules of conduct

You agree not to:

  • Harass, threaten, stalk, intimidate or abuse anyone, on or off the platform.
  • Post or send sexual content involving minors, or anything that sexualises a minor, in any form. This results in immediate permanent removal and a report to the relevant authorities.
  • Send unsolicited sexual images.
  • Impersonate anyone, use someone else's photos, or misrepresent your age or identity.
  • Post external links of any kind, or share Snapchat handles, in your bio, your profile fields or your messages. Nova blocks these automatically. Keeping first contact on the platform is what makes blocking and reporting mean anything.
  • Use Nova for commercial purposes: advertising, promotion, recruitment, selling anything, soliciting money, directing people to paid content, or cryptocurrency and investment pitches.
  • Ask other members for money, gift cards or financial information, for any reason.
  • Scrape, crawl, bulk-download or otherwise harvest profiles, photos or messages, by any means, including automated access to our API.
  • Reverse engineer, interfere with, overload or attempt to gain unauthorised access to any part of the service.
  • Record, screenshot or republish another member's photos, messages or profile outside Nova without their consent.
  • Post content that is unlawful, hateful, or incites violence.
  • Abuse the reviews feature: reviews are for your own honest experience of someone you matched with, not for retaliation or coordinated targeting.
  • Use a note sent with a like to send anything you could not send as a message. A note goes to someone who has not agreed to hear from you, so the conduct rules above apply to it with less margin, not more.
  • Use the reopen on a missed match to repeatedly push yourself back into someone's list. You get one reopen per match for exactly this reason.

5. Matching, messaging and the 72-hour window

How a conversation starts on Nova is part of the service rather than a setting, so it is worth stating plainly:

  • You match when you both swipe right. Nobody can message you without that.
  • A new match has 72 hours for one of you to say something. Either of you can be the one to do it, unless the rule below applies.
  • In a match between one man and one woman, the woman sends the first message. Once she has, you can both talk freely. Every other pairing is open from the start.
  • The first message ends the clock permanently. There is no reply timer and no expiry on a conversation that has started. We are not going to delete a conversation you are in the middle of.
  • If nobody speaks, it becomes a missed match. It is not deleted. It moves to its own list and either of you can reopen it once, which gives you both a fresh 72 hours and removes the first-message rule from that match.
  • A like can carry a short note. The person you liked can read it whether or not they match with you. It is not a message and it does not let you start a conversation it is not your turn to start.
  • Unmatching is permanent and works both ways. It removes the conversation for both of you and neither of you will be shown to the other again. Neither side can undo it, including us.

We may change these timings as we learn how they work in practice. If we do it materially, section 12 applies.

6. Reviews

Nova lets members leave emoji-tag reviews of people they have matched with. By using the feature you accept that:

  • You may only review someone you have actually matched with, and only once.
  • Reviews are shown as anonymous aggregate counts. Your name is not shown to the person you reviewed, but we store it and will act on misuse.
  • Reviews must reflect your genuine experience. Leaving a review to punish, mislead or coordinate against someone is a breach of these terms.
  • Counts are only displayed once a profile has enough reviews that no single review determines what is shown.
  • Other members may review you on the same terms, and you cannot remove a review about you. You can see your own totals at any time.

7. Content you post

Your content stays yours. You grant Nova a non-exclusive, worldwide, royalty-free licence to host, store, resize and display it for the purpose of operating the service — that is, showing your profile to other members. That licence ends when you delete the content or your account, except for copies retained in backups for the period described in the Data Retention statement.

We do not use your photos or messages in advertising, and we do not license them to anyone else.

8. Safety, and what we are not

We verify photos when members ask us to, and we remove people who break these rules. We do not run criminal background checks, and verification is not a character reference. A verified badge means the photos match a selfie — nothing more.

You are meeting strangers. Please read our safety guidance, tell someone where you are going, and meet in public the first time.

9. Suspension and removal

We may suspend or permanently remove an account that breaks these terms, that we reasonably believe is being used to harm others, or where removal is required by law. Serious cases — anything involving minors, credible threats of violence, or fraud — result in immediate permanent removal without warning.

Bans are enforced against your phone number, not just your account, and are recorded as a one-way hash so that deleting the account and signing up again does not lift the ban.

If you believe we have removed you in error, write to Support@viridiandynamics.com.au. We will look at it. We will not reinstate accounts removed for anything involving minors.

10. Closing your account

You can close your account and delete your data yourself, at any time, from Profile → Settings → Close my account. There is no retention period and no reactivation. What survives is set out in the Data Retention statement.

11. Disclaimers

Nova is provided “as is”. We do not promise that it will be uninterrupted, error-free, or that you will meet anyone. We are not responsible for the conduct of other members, online or in person.

To the fullest extent permitted by law, Nova is not liable for indirect, incidental or consequential loss arising from your use of the service. Nothing in these terms excludes liability that cannot lawfully be excluded, including under consumer protection law that applies to you.

12. Changes to these terms

We record which version of these terms you accepted. If we make a material change, we will ask you to accept the new version before you carry on using Nova, rather than changing them underneath you.

13. Governing law

These terms are governed by the laws of Australia. Viridian Dynamics is an Australian business and Nova's member data is held on servers in Sydney, Australia.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement. Where such a law applies and we are permitted to limit our liability, our liability is limited to resupplying the service or paying the cost of having it resupplied.

If you are outside Australia, you may also have rights under your own consumer law that these terms do not take away.
